SIWAI ("we," "our," or "us") is a company incorporated in France. By accessing and using SIWAI ("the Service"), you accept and agree to be bound by these Terms of Service. Your use of the Service is also governed by our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please do not use the Service.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

You are responsible for all activities that occur under your account.
SIWAI is one plan: $99 per month or $990 per year (2 months free). The founding rate is locked on your account. Subscription fees are processed through Stripe and are charged in advance.
By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except as required by law or under the time guarantee below.
Time guarantee: If after 7 mornings of using SIWAI you still need more than 15 minutes to review that morning's feed, email contact@siwai.app for a full refund of the first charge. This guarantee covers time spent reviewing the feed, not trading results. You still take the trade.
EU/EEA/UK consumers: You have the right to withdraw from your subscription within 14 days of purchase without giving any reason. To exercise this right, contact us at contact@siwai.app. If you have already used the Service during this period, we may deduct an amount proportional to the service provided.
The founding rate you subscribe at stays on your account. We may change the public price for new customers. Existing subscribers will be notified at least 30 days in advance of any change that would apply to them. If you do not agree, you may cancel before the change takes effect.
SIWAI provides tools for market analysis and trade execution. We are not a registered broker-dealer or investment advisor. All trading decisions and executions are your sole responsibility. You acknowledge that:
Your brokerage API keys are stored locally in your browser and never transmitted to our servers. You are responsible for maintaining the security of your API keys and for all trades executed through your connected accounts.

The Service, including all content, features, and functionality, is owned by SIWAI and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
The Service integrates with third-party services including:
Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
The Service provides market data, analysis tools, and pattern recognition. This information is for educational and analytical purposes only and does not constitute investment, financial, or trading advice. You should consult with qualified financial advisors before making investment decisions.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIWAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless SIWAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
You may terminate your account at any time by canceling your subscription and contacting us at contact@siwai.app.
Upon termination, we will handle your personal data in accordance with our Privacy Policy. Your data will be deleted or anonymized within 30 days, except where we are required to retain it for legal compliance.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
EU/EEA/UK consumers: If you are a consumer residing in the European Union, European Economic Area, or United Kingdom, you may bring any dispute in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
Other users: For users outside the EU/EEA/UK, any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce (ICC), with the seat of arbitration in Paris, France.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and SIWAI regarding the Service and supersede all prior agreements and understandings.
If you join the SIWAI affiliate program, you earn a commission when people you refer subscribe, on the terms published on the Affiliate page. Self-referrals and fraud are not paid. We may refuse, pause, or close affiliate access if we reasonably believe the terms are being abused. Payouts are handled through our affiliate provider. The program does not change these Terms for users of the Service.
We reserve the right to modify these Terms at any time. Material changes will be notified to you via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
